"A WIFE Who Is LEGALLY MARRIED To A MAN CANNOT Claim That Her HUSBAND R∆P£D Her No Matter The CIRCUMSTANCES"
In a controversial statement, Nigerian lawyer Stella Justice asserts that under current Nigerian law, a legally married wife cannot claim her husband raped her, no matter the circumstances, as spousal rape is not recognized in Nigerian law under Section 282(2) of the Penal Code and Section 357 of the Criminal Code.
"CAN A HUSBAND R∆PË HIS WIFE?
A WIFE who is LEGALLY MARRIED to a MAN CANNOT claim that her HUSBAND R∆PED her no matter the CIRCUMSTANCES under which the HUSBAND had S.£X with her.
This is because, the OFFENCE of SPOUSAL or MARITAL R∆P£ is YET to be provided in any LAW in NIGERIA.
A man CANNOT be CONVICTED for the offence of R∆P!ÑG his WIFE.
